1. Who We Are
Keep Your Lead is a sole proprietorship registered in Ontario, Canada, operating under the name Keep Your Lead. We provide CRM and lead management software services to trades businesses. References to "we," "us," or "our" mean Keep Your Lead. References to "you" or "Client" mean the individual or business subscribing to our service.
2. The Service
Keep Your Lead provides access to a branded, cloud-based CRM and lead management platform built on top of GoHighLevel technology. The platform includes tools for pipeline management, automated follow-up, reputation management, and client communication.
Access to the platform is provided on a subscription basis. We reserve the right to update, modify, or discontinue features of the service at any time, with reasonable notice where possible.
3. Subscriptions and Payment
Our standard subscription is billed at CA$297 per month, charged in advance on a recurring monthly basis. Pricing for founding clients may differ as communicated in writing at the time of signup.
Payment is processed via Stripe. By subscribing, you authorize Keep Your Lead to charge your payment method on file each billing cycle. You are responsible for keeping your payment information current and accurate.
Usage-based charges (such as SMS, phone calls, and email sends) may be billed in addition to the monthly subscription fee and will be disclosed before you incur them.
4. Refunds and Cancellations
All subscription fees are non-refundable. We do not offer pro-rated refunds for unused portions of a billing period.
You may cancel your subscription at any time by contacting us at support@keepyourlead.ca. Cancellation takes effect at the end of your current billing cycle. Access to the platform continues until that date.
We reserve the right to suspend or terminate your account if payment fails and is not resolved within 7 days of notice.
5. Your Responsibilities
By using the service, you agree to:
- Use the platform only for lawful business purposes.
- Comply with all applicable Canadian federal and provincial laws, including Canada's Anti-Spam Legislation (CASL) when sending commercial electronic messages.
- Not use the platform to send unsolicited communications, harass, defame, or defraud anyone.
- Keep your login credentials confidential and notify us immediately if you suspect unauthorized access.
- Ensure you have the right to upload and use any data, contacts, or content you add to the platform.
6. Intellectual Property
All content, branding, and materials provided by Keep Your Lead remain our property. You retain ownership of the data and contacts you upload to your account. You grant us a limited license to process that data for the purpose of providing the service.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Keep Your Lead shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service — including but not limited to loss of revenue, data, or business opportunities — even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from these Terms or your use of the service is limited to the amount you paid us in the 30 days preceding the claim.
8. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that results from using the service will meet your expectations.
9. Third-Party Services
The Keep Your Lead platform relies on third-party infrastructure including GoHighLevel and Stripe. We are not responsible for the availability, performance, or practices of these third-party providers. Their own terms of service and privacy policies apply to their respective services.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and, where the change is material, notify you by email. Your continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ontario.
